What To Expect When Hiring A Criminal Defense Lawyer

Many people feel nervous before meeting with an attorney. By learning more about what to expect when hiring a criminal defense lawyer, you can go to your first consultation feeling calm and confident.

Criminal defense attorneys represent clients who face suspicion, investigation, arrest or prosecution in the criminal justice system. You do not need to have criminal charges pending to hire a lawyer. Your defense attorney can help you at any point in a criminal case.

At your first meeting, your lawyer will ask you questions about your case. You should answer to the best of your ability–and you should be honest. Lawyers have a strict duty to protect the confidentiality of what you tell them. In fact, it is best to be honest with your legal team so that they can create the best possible defense strategy.

Will Hiring A Lawyer Make Me Look Guilty?

This belief is completely false. Hiring an attorney is one of the most intelligent choices you can make–even if you are innocent. And it’s an important right guaranteed by the U.S. Constitution. You will not look suspicious by working with a lawyer to protect your rights, and judges and juries cannot hold that fact against you.

What Will A Defense Attorney Cost?

In addition to worrying about your criminal case, you are also worried about the cost of hiring a private law firm. Working with a free court-appointed lawyer may seem tempting if you qualify. But public defenders have heavy caseloads and often can’t devote the same level of attention and resources to your case. You deserve tailored representation from lawyers who are the best-equipped to handle your defense, taking into account the severity and complexity of the charges–and the potential consequences you may be facing.

How To Choose A Criminal Defense Lawyer

Now, you need to figure out how to choose a criminal defense lawyer. The number of options in North Carolina can feel overwhelming. After all, there are many law firms that would do a competent job defending you. But do you want a criminal defense attorney who is merely competent? Or do you want criminal defense attorneys who have the experience and skill to aggressively fight for you until the very end?

If you want to work with a legal team that fights for the best outcome possible at every stage of your legal representation, you should work with us. Marcilliat & Mills PLLC, is the highly acclaimed criminal defense law firm to help you.

But don’t take our word for it. Our honors and achievements-not to mention our many rave client reviews-speak for themselves. We have:

  • Thousands of successful case results
  • Decades of combined criminal defense experience
  • A former North Carolina prosecutor on our team
  • Education at top-rated schools and programs
  • Selection for inclusion in Super Lawyers and Rising Stars
  • AV Preeminent, the highest peer-review rating by Martindale-Hubbell*
  • Selection to the Top 100 Trial Lawyers

Our team can work with you to determine the wisest course of action geared toward obtaining the results you want for your case. Based on an in-depth review of all evidence and circumstances in your case, we can advise you on your options, including whether it’s wise to fight the charges at trial or negotiate a plea deal. In some instances, we can even get key evidence thrown out or get the criminal charges dropped completely.

What Are The Signs Of A Bad Lawyer?

Just as there are good defense attorneys, there are also bad defense attorneys. You do not want to make the mistake of hiring an incompetent lawyer who will fail to adequately defend you.

Some of the warning signs of a bad criminal defense attorney include:

  • Lack of experience
  • Few, if any, positive case results
  • Little to no communication
  • Poor understanding of the legal system
  • Missing important deadlines
  • Pressuring you to enter a guilty plea

If a lawyer doesn’t have experience handling the particular type of charges (or investigation) you’re facing, run the other way.

What About The Cost?

The cost of legal fees is an issue for many clients. But when your criminal record, freedom or even your life is in peril, money should not be your top concern. Instead, you should focus on finding the best possible attorney for your situation.

While court-appointed lawyers will work for you for free if you qualify, you should consider them only as a last option. For all their hard work and skill, public defenders are often overburdened with heavy case loads. They may not be able to give your criminal case their full attention.

Many people who think they can’t afford a private attorney can, in fact, come up with the resources to hire one when the stakes are high enough. And it’s well worth it to do so.

Your wisest choice is to enlist a private criminal defense attorney like the ones at Marcilliat & Mills PLLC. We base our fees on the specifics of your case. The effort, skill and devotion that we put into your defense is well worth the money.

State v. B.S.: Not Guilty Verdict in First Degree Murder Case.

In this case, our client was charged with First Degree Murder in connection with a “drive by” shooting that occurred in Charlotte, NC. The State’s evidence included GPS ankle monitoring data linking our client was at the scene of the crime and evidence that our client confessed to an inmate while in jail. Nonetheless, we convinced a jury to unanimously find our client Not Guilty. He was released from jail the same day.

State v. S.G.: First Degree Murder Charge Dismissed.

Our client was charged with First Degree for the shooting death related to an alleged breaking and entering. The State’s evidence included a co-defendant alleging that our client was the shooter. After conducting a thorough investigation with the use of a private investigator, we persuaded the State to dismiss entirely the case against our client.

State v. B.D.: First Degree Murder Charged Dismissed.

After conducting an investigation and communicating with prosecutor about the facts and circumstances indicating that our client acted in self-defense, the case was dismissed and deemed a justifiable homicide.

State v. I.R.: Reduction from First Degree Murder to Involuntary Manslaughter and Concealment of Death.

Our client was charged with the First Degree Murder of a young lady by drug overdose. After investigating the decedent’s background and hiring a preeminent expert toxicologist to fight the State’s theory of death, we were able to negotiate this case down from Life in prison to 5 years in prison, with credit for time served.

State v. J.G.:

Our client was charged with First Degree Murder related to a “drug deal gone bad.” After engaging the services of a private investigator and noting issues with the State’s case, we were able to negotiate a plea for our client that avoided a Life sentence and required him to serve only 12 years.
