DISMISSALS
State v. J.A. – First Degree Rape
The War on Drugs is an abject failure, but our government still succeeds at jailing and imprisoning more people for drug charges than anywhere else on the planet.
Our philosophy in drug cases is straightforward: Aggressive criminal defense that puts people first.
You’re a person, not an addict or drug dealer.
Perhaps nothing encapsulates the irony of criminal justice and politics in America more than drugs, their use by individual citizens, how drugs are marketed and sold, and how the government punishes people for behavior that hasn’t been officially “blessed” by both lawmakers and the pharmaceutical industry.
Other than sex crimes, very few crimes are as politicized in the U.S. than drug offenses. The situation ebbs and flows. The 1920s saw alcohol hysteria and Prohibition, out of which nothing positive came, other than a major lesson in the uselessness and additional societal harm of creating laws that seek to control a person’s liberty and individual choice.
We could go on: Nixon’s War on Drugs, Reagan’s Just Say No, and the striking irony of today – the opioid epidemic, which came about as a direct result of the biggest drug dealer in America: the pharmaceutical industry. (Let us not forget the pharmaceutical industry’s not-incidental opposition to marijuana legalization, as well as the legitimate businesspeople who now seek to cash in on a plant that the DEA says has no positive benefit whatsoever.)
There’s a reason we have the record of results in drug cases that we do.
At Marcilliat & Mills PLLC, we handle the tough cases, from misdemeanor possession of drug paraphernalia to felony trafficking. There is a lot at stake in our clients’ lives.
Our clients range from the UNC Charlotte college student to what the government calls a “drug kingpin” (while excluding the pharmaceutical industry from that label), and we’ve won great results across North Carolina against state charges and federal charges, from the mountains to the coast.
Whether it’s a jury acquittal, a reduction in charges, a dismissal, or avoiding prosecution altogether, we do everything in our power to defend our clients against drug charges.
Our country cannot seem to get its priorities straight. It doesn’t seem to understand the irony of locking people away for drug possession while letting pharmaceutical executives get rich off painkillers. In this situation, your lawyer is the one person who can cut through this mess and work to get the best result possible under the circumstances.
